Please Take The Time To Read These Terms And Conditions Of Use Carefully Before You Place An Order For Any Of Our Goods

Terms and Conditions of Sale of 

World Wide Shopping Mall Limited (Registered in England No 3307834) Hillview House, Sheriff Hutton, York, YO60 6QJ.

For the purposes of this statement the following descriptions will be used: The World Wide Shopping Mall shall be (“The Company”). The person buying goods shall be (“The Customer”). The purchased products shall be (“The Goods”). Standard terms and conditions of sale set out in this document shall be (“Conditions”). The virtual shopping basket and checkout shall be (“The Basket”). Any order placed by The Customer with The Company for the supply of Goods, by means of the electronic order form system, completed and submitted electronically by The Customer or by any other manual means shall be (“The Order”). The debit or credit card of the Customer to be used as the payment means for the Goods for which the Customer has provided details to the Company when placing The Order shall be (“Customer's Credit Card”) The World Wide Shopping Mall Ltd’s Virtual Mall shall be (“Web Site”).

Your statutory rights are not affected by the contents of this statement, it does not confer upon you any additional legal obligations or duties, it merely highlights existing rights that consumers have whenever they deal with traders.

The way these Conditions are set out in this document are for convenience only and shall not affect their interpretation.

These Terms and Conditions of Sale cover the supply of ‘all products’ supplied by The Company to The Customer including vitamins, minerals, herbal remedies, health & food supplements, toys, models, books, videos, cassettes, pottery, crystal, cutlery, pet and other animal products, shoes, handbags, accessories, lighting, beauty products or any other products, The Company may in the future sell.

The price of each item of The Goods, subject to the provisions of the clause The Selling Price (see below), including additional delivery costs where charged, is inclusive of Value Added Tax if applicable. The price is displayed next to the relevant item’s page and in The Basket. In addition to The selling price, The Customer will have to pay a delivery charge unless The Customer qualifies for free delivery. Where a delivery charge is payable The Customer will be notified in advance of The Customer’s order being processed and the amount will be subject to The Customer’s prior approval. The amount of the delivery charge depends on the method of delivery and the delivery address The Customer specifies in The Order.

The Company makes every effort to ensure delivery is met in accordance with the timescale indication given for each product, however The Company does not accept any liability for the late delivery of The Goods and The Customer’s attention is drawn to the contents of ‘Delivery of The Goods’ see below. The provisions of: - The EU Directive on the Protection of Consumers in respect of Distance Contracts will operate, you have the right to withdraw from this transaction. Details of your right to withdraw are set out in Right To Withdraw see below.

World Wide Shopping Mall Limited reserves the right, at its discretion, to modify the content of these terms and may change, add or remove parts at any time. The Customer is advised to periodically re-read the terms to check for changes.

Basis of The Sale

The Company shall sell and The Customer shall purchase The Goods in accordance with the detail of The Order provided by The Customer and which the Company accepts

The Order

The Customer shall ensure that any Order submitted by the Customer to The Company is accurate, and it has sufficient information relating to the Goods required and that sufficient time is allowed to enable the Company to perform its duties within its terms. An order submitted by The Customer shall not deemed to be have been accepted by The Company unless confirmed in writing by The Company, this confirmation may be by mail, fax or by electronic means. An order shall be deemed to be have been accepted where the Company has deducted payment for The Goods from The Customer's Credit Card. The Company accepts The Order for The Goods subject to availability. If The Order cannot be fulfilled The Customer has the opportunity to either cancel The Order or to accept any alternative Goods that may be offered.

The Selling Price

The selling price of The Goods shall be The Company's displayed price at the date of acceptance of the Order. For UK customers the price is inclusive of any applicable value added tax ("VAT"). For orders for delivery outside of the UK, the price displayed on the website is the price you pay regardless of VAT status. We do not discount International orders. The customer is responsible for paying all import duty costs. The selling price is exclusive of duty. The Company reserves the right, to increase the displayed price of the Goods from time to time reflecting any increased cost to the Company.

Discounts & Special Offers

The Company reserves the right to vary or terminate the operation of any special offer or promotional offer at any time without notice. All offers are subject to availability and while stocks last. The offers are non-transferable and not exchangeable for cash, alternatives will not be offered. Any special offer or promotion excludes any delivery charge, and are not eligible for free delivery. The Company shall not be liable to any customer for any financial loss arising out of the refusal, cancellation or withdrawal of any special offer or promotion or any failure or inability of a customer to use a special offer or promotion for any reason. Where a product qualifies for more than one special offer, The Company reserves to right to restrict the offer to the lowest monetary amount. Refunds for goods purchased under a special or promotional offer will be based on the terms of the promotional price. Your statutory rights are not affected.

Product Specification & Image

The Product description and specification as displayed on the Web Site is only approximate and The Company reserves the right to make any alterations which does not materially affect the quality or performance of those products. Product image is for illustrative purposes only and actual product packaging may differ to that shown in photograph. The Customer must always refer to detailed product wording rather than rely on any Product image for information. In addition, The Company reserves the right to make any changes in the specification of the Goods which are required to conform to any applicable statutory or EC requirements.

Payment

The Customer warrants that the information contained in The Order is true and accurate; payment for The Goods shall be by cash, cheque, money order, bank order or by Customer's Credit Card payment.

Where payment is by Customer's Credit Card, the customer warrants that the information provided is true and accurate and that he or she is duly authorised to provide such information and allow the deduction of a payment from the Customer's Credit Card. On presentation of Customer's Credit Card information The Customer duly authorises The Company to perform validation checks and authorisation with the card issuer, if authorisation is declined, The Company will not accept any liability for delays or non-delivery. The Customer duly authorises The Company to make the deduction of a payment from the Customer's Credit Card in accordance with the value of The Order.

We have the facility to charge you in your card billing currency when we process this transaction. This service gives you an opportunity to pay for the goods in the currency of your card as opposed to pounds sterling. The rate of exchange used for the transaction is sourced daily from Reuters and is competitive and comparable with the rate used by card insurers. A 2.75% international conversion margin is included in the rate. Where Goods are returned by The Customer, The Customer authorises the credit, using the previously provided Customer’s Credit Card information, to the Customer's Credit Card. Where payment has not been made in full the Company shall be entitled to cancel The Order and/or suspend any further deliveries to the Customer. Where full payment has not been made The Company will be entitled to charge The Customer interest at rate of 3% above HSBC Bank Plc base rate applicable at the time of the calculation until payment is made in full. The company will take all reasonable steps to ensure that The Customer’s Credit Card information is kept secure, however, unless The Company has been negligent, The Company will not be liable for any losses arising from unauthorised access by a third party to the Credit Card information transmitted by The Customer.

Delivery of The Goods

Delivery of The Goods shall be made directly by The Company or The Postal Service or by The Company’s carrier, to the address provided by The Customer on The Order. Every effort will be made by The Company to ensure that The Goods are delivered within the specified time, however any dates quoted for delivery of The Goods are approximate only and the Company shall not be liable for any delay in delivery of the Goods howsoever caused, not withstanding this The Goods may delivered in advance of the quoted delivery date.

Where circumstances prevail The Goods, at the discretion of The Company, may be delivered in part, where this takes place failure to deliver the remaining part/parts of The Order shall not render the whole order void, each delivery shall constitute a separate contract.

Where delivery is not completed to The Customer’s nominated delivery point The Company is liable, the extent of this liability shall be limited to the price of the goods. The Company reserves the right to despatch by the least expensive method where a charge for delivery is not being made. Where The Customer does not take delivery of the Goods or does not supply adequate delivery information The Company may cancel The Order and retain The Goods. In this event, The Company will refund The Customer for the price of The Goods but The Customer will be liable to pay any delivery charges.

Where there are any problems with delivery in respect of The Goods ordered, The Customer must notify The Company, in writing, within 2 days after the delivery date. The Company will not be liable for any loss or damage if the Customer fails to do this. Where the delivery does not arrive as expected The Customer must inform The Company within 28 days from the date of the shipment email.  The Company will not be held responsible for any items not received if The Customer fails to let The Company know within this 28 day timescale.  The Company will not be liable if The Customer has entered incorrect email contact details when registering with The Company.

Where any delivery does not arrive as a result of a Royal Mail Loss then Royal Mail require The Company to wait 15 working days after despatch before any resend or refund is offered, as Royal Mail would not consider an item as lost until 15 working days have elapsed.

Liability

Where The Customer has notified The Company as to a problem with The Goods, The Company will (at The Customer’s option) either make good any shortage or non-delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to The Customer the amount paid by The Customer for the goods in question.

The Company will not be liable to The Customer for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to The Goods and The Company shall have no liability to pay any money to The Customer by way of compensation other than a refund equal to the price of The Goods. This does not affect The Customer’s statutory rights as a consumer, nor is it intended to exclude The Company’s liability to The Customer for fraudulent misrepresentation or for death or personal injury resulting from The Company’s negligence. Unless in respect of the above, The Company shall not be liable to The Customer for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of the Company, its employees or otherwise) which arise out of or in connection with the supply of The Goods or their use or resale by the Customer. The risk of damage or loss of The Goods shall pass to The Customer when delivery is made. The Company can accept no claim beyond this point.

The above does not apply to deliveries where The Customer has selected the ‘Airmail’ option for posting. As described on the website where The Customer has selected ‘Airmail’ this is an uninsured service and The Customer takes the responsibility of the parcel going astray during post. The Company will only accept liability for goods going astray during International post if ‘Airmail Insured’ or a courier service is selected during the checkout process.

Errors and Omissions

Any printing or typographical errors or omissions in any sales literature, quotations, price lists, acceptance of offers, invoices or other document or information shall be subject to correction, and such errors or omissions will not provide liability to The Company. The Company has made every effort to ensure that the information contained within the Web Site is accurate. However, The Company makes no representation and gives no warranty of any kind in respect of this information.

The Company does not accept liability for any damage or loss, whether direct, indirect or consequential, which may arise as a result of relying on the information contained within the Web Site. Nor does The Company accept any liability in respect to any omission or error except in relation to death or personal injury caused by The Company’s negligence, or any of its employees.

Right of Withdrawal

You may withdraw from your order by giving The Company notice of cancellation within 14 days starting the day after delivery. Such notice may be given by mailing, faxing or emailing to the number or address set out on the order form. If you are withdrawing because of any problem with the goods, please notify The Company of the problem at the time of cancellation. In some special cases you do not have the right to withdraw, these include: Goods made to your personal specifications, Goods which by reason of their nature cannot be returned or are liable to deteriorate rapidly (e.g.. flowers or foods), Sealed audio or video recordings or computer software which you have opened, Other sealed Goods which you have opened, Goods which have already been used, however, The Customer’s statutory rights concerning the quality of those products will be unaffected. On cancellation for whatever reason, you must return the goods to The Company at your cost unless the goods are being returned because they are faulty, incorrect goods or because of unsuitable substitution by us, in which case we will meet the cost of return but we ask that you allow The Company to nominate the carrier. The Customer has a duty of care for the goods during this cancellation period. For The Customer’s benefit it is advisable to obtain a certificate of posting from the Post Office as The Company cannot be held responsible for any returned items not arriving here safely. The right of withdrawal does not affect any of the Customer's statutory rights.

Force Majeure

The Company shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).

General

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which The Company exclude their liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.

Those Customers accessing this site from locations other than the United Kingdom are responsible for compliance with their own local laws, and to what extent their local laws are applicable to their purchase. When ordering goods for delivery overseas The Customer be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by The Customer; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so The Customer should contact their local customs office for further information. Please note that the local customs office may open and inspect your goods. For further information please contact your local Customs Information Office.

The Company confers no contractual rights on third parties, and The Contracts (Rights of Third Parties) Act 1999 shall not apply to any contract between The Company and The Customer.

The company cannot guarantee The Customer’s uninterrupted access to this Web Site, and will not accept any liability for any loss or damage arising from problems with access.

The Web Site may contain links to other Web Sites not under the control of The Company. The Company accepts no responsibility or liability for material on Web Sites not under the control of The Company.

The naming on the web Site of other companies, organisations, products and therapies does not imply endorsement by The Company.

Health Warning on Vitamins Supplements and Herbal Remedies

World Wide Shopping Mall Limited has used all reasonable effort to ensure that the information included in the material on the Web Site e.g. product data is accurate and up to date; it however can make no warranties or representations as to the accuracy of such information. It must be emphasised that the information provided on the products depicted is for guidance only and cannot be considered to be medical advice. The Company will not be liable to any person for any loss or damage that may arise from use of the information contained within material on this Web Site.

As with most alternative remedies the benefits said to be received from their usage are usually based on historical information, sometimes passed down through the centuries.
